The Memory Nest – Babysitter Agreement (Self-Employed)

1. Status of Relationship

1.1 The Memory Nest acts as an introductory and booking platform only.
1.2 Babysitters registered with The Memory Nest are self-employed independent contractors.
1.3 Nothing in this agreement creates an employment relationship, worker status, partnership, or agency relationship.
1.4 Babysitters are not entitled to holiday pay, sick pay, pension contributions, or any employment benefits.

2. Self-Employment & Tax Responsibility

2.1 Babysitters are fully responsible for:

  • Declaring earnings to HMRC

  • Paying their own tax and National Insurance

  • Managing their own financial records

2.2 The Memory Nest does not process wages or handle payments between clients and babysitters.

3. Rates & Payment

3.1 The Memory Nest publishes standard recommended rates for bookings made through its platform.

3.2 Babysitters remain free to accept or decline any booking offered and are under no obligation to accept work.

3.3 By accepting a booking through The Memory Nest, the babysitter agrees to charge the client the published rate for that specific booking.

3.4 Payment is made directly from the client to the babysitter upon completion of the booking. The Memory Nest does not process payments and is not responsible for unpaid fees.

3.5 Babysitters are solely responsible for declaring earnings to HMRC and managing their own tax and National Insurance contributions.

3.6 Nothing in this agreement creates an employment relationship, worker status, or mutual obligation to provide or accept work.

4. Bookings & Non-Circumvention

4.1 All bookings with families introduced through The Memory Nest must be arranged through The Memory Nest platform.
4.2 Babysitters must not accept direct bookings, private arrangements, or ongoing work with families introduced via The Memory Nest without written consent.
4.3 Circumventing The Memory Nest to avoid booking fees may result in immediate removal from the platform.

5. Vetting Requirements

5.1 Babysitters must hold:

  • Enhanced DBS (children’s barred list)

  • Legal Right to Work in the UK

  • Minimum of two satisfactory childcare references

5.2 Babysitters must notify The Memory Nest of:

  • DBS expiry

  • Criminal investigations

  • Changes affecting suitability to work with children

6. Professional Conduct

Babysitters agree to:

  • Act professionally at all times

  • Arrive punctually

  • Follow safeguarding practices

  • Communicate clearly with families

  • Report any incidents or safeguarding concerns immediately

7. Insurance

7.1 The Memory Nest holds business insurance covering its activities as an introductory service.
7.2 Babysitters are responsible for obtaining any personal insurance they deem necessary.

8. Liability

8.1 Babysitters accept full responsibility for their actions during bookings.
8.2 The Memory Nest is not liable for any injury, loss, damage, or dispute arising during a babysitting session.

9. Removal from Platform

The Memory Nest reserves the right to suspend or remove a babysitter at its discretion for:

  • Safeguarding concerns

  • Breach of terms

  • Professional misconduct

  • Repeated cancellations

10. Governing Law

These terms are governed by the laws of England and Wales.
