Welcome to The Memory Nest Babysitting Services. By using our services, you agree to the following terms and conditions. Please read them carefully.

1. Definitions

Agency: Refers to The Memory Nest the provider of babysitting services.

Parent/Client: Refers to the individual(s) contracting the babysitting services.

Babysitter: Refers to the individual provided by the Agency to perform babysitting duties.

Service: Refers to the act of babysitting provided by the Babysitter through the Agency.
2. Eligibility
-
Parents must be at least 18 years old to use our services.
-
Parents must provide accurate and complete information when registering with the Agency.
3. Booking and Payment
-
All bookings must be made through the Agency’s official booking system.
-
Upon booking, a non-refundable booking fee will be invoiced by the Agency. This fee must be paid in advance to confirm the booking.

After completing the babysitting service, Parents are required to pay the Babysitter in cash.

Cancellations made less than 12 hours before the scheduled start time will incur a cancellation charge equivalent to the first 3 hours of the sit.

Agency-Initiated Cancellations: In the rare event that we need to cancel a booking, we will notify you as soon as possible and provide a full refund of the booking fee for that session or offer a rescheduled session at no additional cost.
4. Babysitter Assignment

The Agency will assign a qualified Babysitter based on availability and the Parent's specific requirements.

The Agency reserves the right to substitute a Babysitter in case of unforeseen circumstances.
5. Parent Responsibilities
-
Parents must provide the Babysitter with accurate and comprehensive information about the child’s needs, allergies, medications, and any special instructions.

Parents must ensure the home environment is safe and provide all necessary supplies for the child’s care.

Parents must return at the agreed-upon time. Any overtime will be charged at the standard hourly rate and paid directly to the Babysitter in cash.
6. Babysitter Responsibilities

Babysitters will provide attentive, responsible, and professional care for the child.

Babysitters will follow all instructions provided by the Parents regarding the child’s care.

Babysitters will not bring unauthorized persons to the home or leave the child unattended.
7. Liability
-
The Agency conducts thorough background checks on all Babysitters; however, the Agency is not liable for any acts of negligence, misconduct, or any damages caused by the Babysitter.

Parents agree to indemnify and hold the Agency harmless from any claims arising from the Babysitter’s service.
8. Confidentiality

The Agency and Babysitters will keep all personal information about the Parents and children confidential and will not disclose such information to third parties except as required by law.
9. Termination of Service

Either party may terminate the use of the Agency’s services with written notice.

The Agency reserves the right to terminate services if the Parent violates any terms and conditions or if the Babysitter’s safety is at risk.
10. Dispute Resolution

Any disputes arising from the use of the Agency’s services shall be resolved through mediation. If mediation fails, the dispute shall be settled in the jurisdiction where the Agency is located.
11. Subscription Plan Terms
To ensure a seamless and cost-effective experience for our clients, we offer a subscription plan that provides a reduced booking fee for a period of 3 months. By subscribing, customers can enjoy high-quality babysitting services at a discounted rate. Please read the following policy carefully before signing up.
Subscription Details

Subscription Duration: The subscription lasts for 3 months from the date of purchase.

Reduced Booking Fee: Subscribed customers receive a discounted rate on the booking fee for each babysitting session during the subscription period.

Eligibility: Subscription is available to all new and existing customers.
Pricing and Payment

Subscription Fee: The cost of the 3-month subscription is £30. This fee is non-refundable and must be paid in full at the time of signing up.

Discounted Booking Fee: 3 month subscribed customers will pay a booking fee of £5 per session, as opposed to the standard booking fee of £17.50.

Payment Methods: We accept payments via credit card, debit card, and other approved payment methods. All payments are processed securely.
Booking and Cancellations

Booking Process: Subscribed customers can book babysitting services through our website or by contacting our customer service team. Please provide your subscription details when making a booking to avail of the discounted rate.

Customer-Initiated Cancellations: If a customer cancels a booking, they must notify us as soon as possible. Cancellations made less than 12 hours before the scheduled start time will incur a cancellation charge equivalent to the first 3 hours of the sit.

Agency-Initiated Cancellations: In the rare event that we need to cancel a booking, we will notify you as soon as possible and provide a full refund of the booking fee for that session or offer a rescheduled session at no additional cost.
Subscription Renewal and Termination

Renewal: Customers will receive a reminder email two weeks before the end of the subscription period. To continue enjoying the discounted booking fee, customers must renew their subscription before the current period expires. The renewal fee is the same as the initial subscription fee.

Termination by Customer: Customers may choose not to renew their subscription after the 3-month period. There is no penalty for not renewing.

Termination by Agency: We reserve the right to terminate a subscription if the customer breaches any terms of this policy or engages in inappropriate behaviour. In such cases, no refund will be provided.
General Terms

Non-Transferable: The subscription is non-transferable and can only be used by the registered customer.

Changes to Policy: We reserve the right to modify this subscription policy at any time. Customers will be notified of any changes via email or through our website.
12. Changes to Terms and Conditions

The Agency reserves the right to modify these terms and conditions at any time. Parents will be notified of any changes, and continued use of the services constitutes acceptance of the new terms.
13. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the UK.​

For the Babysitter
These Terms of Use ("Terms") govern the relationship between you, the babysitter ("Babysitter"), and The Memory Nest ("Agency") as part of your engagement to provide babysitting services to clients ("Clients") through the Agency. By accepting assignments from the Agency, you agree to comply with these Terms.

1. Responsibilities and Expectations
Professional Conduct

Babysitters must conduct themselves in a professional manner at all times.

Maintain confidentiality regarding the Clients’ personal information and household matters.

Adhere to the specific instructions provided by the Clients concerning child care, routines, and house rules.

Avoid using mobile phones for personal use while on duty, except in emergencies or to communicate with the Agency or Clients.
2. Child Safety and Welfare

Ensure the safety and well-being of the children at all times.
-
Avoid any form of physical, verbal, or emotional abuse towards the children.
-
Administer first aid when necessary and seek medical attention promptly in case of emergencies.
-
Refrain from consuming alcohol or drugs before or during babysitting assignments.
3. Punctuality and Reliability

Arrive on time for all scheduled assignments.
-
Notify the Agency immediately if you are unable to attend an assignment or if you will be late.
-
Do not cancel assignments without providing sufficient notice except in cases of emergency.
4. Communication
-
Maintain open and honest communication with the Agency and the Clients.
-
Report any incidents or issues that arise during the babysitting assignment to the Agency promptly.
5. Contact with Clients
-
Babysitters are prohibited from contacting Clients for private bookings outside of the Agency's arrangements.

Babysitters cannot be hired by Clients directly without the Agency receiving its applicable fee.
-
Babysitters must not initiate contact with Clients when not actively engaged in a babysitting assignment unless explicitly authorised by the Agency.

If you make a permanent offer to any of our babysitters, you will be liable to pay a finders fee (the
current rates will be posted on our website).
6. Employment Status

Babysitters are engaged as independent contractors and not as employees of the Agency.

Babysitters are responsible for their own taxes, insurance, and any other statutory obligations.
7. Compensation

Babysitters will be compensated at the rate agreed upon between the Babysitter and the Agency.

Babysitters will be paid in cash for completed assignments.
-
Babysitters must promptly report hours worked and any additional expenses incurred during assignments as per the Agency’s procedures.
8. Termination of Engagement

The Agency reserves the right to terminate the engagement of a Babysitter at any time for reasons including but not limited to breaches of these Terms, misconduct, or failure to perform duties satisfactorily.

Babysitters must provide a minimum of 2 weeks notice to the Agency if they wish to terminate their engagement.
9. Liability

Babysitters are responsible for their own actions and any consequences arising from their failure to adhere to these Terms.

The Agency is not liable for any damages, injuries, or losses incurred by the Babysitter during their assignments, except where such liabilities are caused by the Agency’s negligence or breach of these Terms.
10. Confidentiality

Babysitters must keep all information regarding the Agency, Clients, and their households confidential.
-
This confidentiality obligation remains in effect even after the termination of the Babysitter's engagement with the Agency.
11. Changes to Terms

The Agency reserves the right to amend these Terms at any time.

Babysitters will be notified of any changes and continued acceptance of assignments will constitute agreement to the revised Terms.
12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [State/Country].

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the UK.
By accepting assignments from the Agency, you acknowledge that you have read, understood, and agreed to these Terms of Use.
